Michael Naugton, co-chair of the firm's Environmental Group, and Michael Gordon co-authored an article titled "The Increasing Emergence of Nuanced Speculative, and Novel Damages in Environmental Litigation: A Select Review of Property "Stigma" Damages and Hydraulic Fracturing Damages" in Commercial Damages Reporter, Volume 30, Issue 1. The article, published in January 2015, provides a general review of the use of speculative property "stigma" damages, which can be applicable to a host of environmental actions, and the use of unique and unusual damages that have been requested in hydraulic fracturing (fracking).
