Trademark Development & Clearance
Our IP attorneys conduct and evaluate trademark searches to determine whether marks are available for use and registration by our clients. We investigate potential problems, negotiate and take the appropriate action on behalf of our clients to secure rights that would otherwise be in question. When it comes to developing and building a brand, CSG Law IP attorneys serve as valuable partners beginning as early as the brainstorming stage, regularly guiding clients through the process of selecting strong and protectable trademarks, service marks and trade dress – and advising throughout the lifecycle of their business regarding proper use and protection of both common law and registered marks.
Trademark Filing, Prosecution & Maintenance
CSG Law clients benefit from our IP Group’s substantial experience in all aspects of trademark prosecution – including the preparation and filing of applications and the prosecution of applications through to registration. Our deep knowledge of the law and creative thinking have allowed clients to overcome office actions with complicated substantive obstacles to obtain federal registrations. When federal registration is not an option, we counsel our clients on how to best protect their rights, including through the filing of state trademark applications. CSG Law IP attorneys also file and manage international trademark applications through the World Intellectual Property Organization and work closely with law firms across the globe to manage and coordinate clients’ international trademark portfolios. Once the registration process is complete, we assist our clients in maintaining their trademark portfolios worldwide, handling post-registration matters such as renewal applications, incontestability declarations and changes of ownership.
Trademark Monitoring & Enforcement
Every day, our attorneys help trademark owners keep a vigilant eye out for potential infringers and conflicting applications. We consult with our clients regarding best practices for enforcing, protecting and expanding their rights in the most cost-effective and efficient manner, and have been able to stop numerous infringers without the need to resort to litigation.
The CSG Law IP group has significant experience assisting clients with the protection of their trade dress, including conducting clearance searches and obtaining federal registration for clients’ distinctive trade dress, such as product packaging, label design and interior and exterior design. We also advise clients on the best ways to protect and enforce unregistered trade dress.
