New York Times: Keeping a Fire Escape Clear

Real Estate Group counsel Gemma Giantomasi was quoted in an article titled “Keeping a Fire Escape Clear” in the Ask Real Estate weekly column in the New York Times. The article posted on May 23, 2015 addresses questions from readers about real estate related issues. A reader asked for the legal and ethical way to handle a tree that leans and extends above a neighbor’s property. The article points out that the tree is the property owner’s responsibility and the owner is liable for damages caused by falling branches or a falling tree. Gemma says, “At the end of the day, the letter writer could be liable. Especially in light of the fact that the letter writer has been made aware of the dangerous condition.”
