CSG Law Environmental Blog: NJDEP Air Permit Checklist Requirement Takes Effect October 16, 2026 – What Applicants Need to Know

The New Jersey Department of Environmental Protection’s Division of Air Quality, Bureau of Stationary Sources (BoSS), has issued revised application checklists for air permit applications. Beginning October 16, 2026, applicants must submit the applicable revised checklist with each air permit application filed with BoSS.

Once the requirement takes effect, an application submitted without the correct completed checklist will be returned as deficient without further action. For applicants, this can mean delays, disruption to project schedules, and additional cost. BoSS is encouraging applicants to begin using the revised forms immediately. The revised forms are available on the BoSS Applications and Forms webpage under “Other Applications and Forms.”

BoSS has replaced the single Air Permit Application Checklist with two fillable PDF forms tailored to facility type: the Air Permit Application Checklist for Minor Source Facilities and the Air Permit Application Checklist for Title V Major Source Facilities. Missing information, if not accompanied by an explanation, may result in an administrative or technical deficiency finding.

BoSS states that the checklists do not impose new substantive permitting requirements. Rather, they are intended to clarify existing application requirements, reduce deficiency notices, and help shorten review times. Businesses planning air permitting activity in New Jersey should update their application filing procedures to include the new checklists well before October 16, 2026.
