The piece explores a set of factors that make the role of outside immigration counsel even more critical to companies that hire foreign nationals – especially today.
In the wake of increased government investigations and raids on employers of foreign nationals, those who don’t have outside immigration counsel cannot rely on attorney/client privilege to shield themselves from overreaching investigations. Though considered more cost-effective in the short term to have in-house counsel prepare immigration paperwork, none of that “work” is privileged and could very well result in exponentially higher long-term costs in the case of an investigation.
