Scott W. Lichtenstein


Scott Lichtenstein practices primarily in the firm's Fidelity and Surety group. His experience in this field includes representing and defending sureties and fidelity insurers in the following scenarios:

  • A performance bond claim exceeding $50 million, in connection with the construction of a public housing project in New Jersey
  • Claims against two multi-million dollar payment bonds executed in connection with the replacement of underground utilities in New York City
  • A multi-million dollar performance bond claim in connection with the construction of a military base in South Carolina
  • A mortgage loan company’s financial institution bond claim for losses it sustained after repurchasing fraudulently-procured loans that it had sold on the secondary market
  • A state taxing authority’s claim against a multi-million dollar cigarette tax bond executed on behalf of a wholesale cigarette retailer (which scenario included pursuing the bond surety’s rights of recovery in an involuntary bankruptcy proceeding filed against the cigarette wholesaler by its creditors)

Scott’s experience also includes assisting sureties in recovering bond losses and expenses from indemnitors.

Scott earned his J.D. at Rutgers University School of Law – Newark, where he was managing editor of the Rutgers Race and the Law Review and received the Dean's Merit Scholarship for all three years of attendance. He received a B. A. in philosophy and political science from Rutgers University, where he graduated magna cum laude, earned departmental honors in philosophy and was inducted into Phi Beta Kappa.

Prior to joining the firm in 2010, Scott clerked for the Honorable Edith K. Payne, J.A.D. in the New Jersey Superior Court, Appellate Division. While attending law school, Scott was employed as a legal assistant at the Law Office of Joseph Carolan, a staff counsel office to CNA Insurance.
