Adam Derman, co-chair of the Wolff & Samson's Litigation Group, was quoted in a New Jersey Business article titled "Commercial Litigation Concerns: In the labyrinth of commercial litigation within our civil justice system, clients may find relief by following time-tested paths." The article, which was published in their November 2014 issue, offers suggestions on how best to handle a lawsuit. Lawyers generally agreed that a company involved in a lawsuit should try to resolve a conflict though mediation and help avoid further expense, but still permit the possibility of a trial at a later date. Mediation can be a tool for resolving commercial litigation cases if it is conducted at the right time. Adam said, "If you have mediation at the beginning of the case, or at the middle of the case, you may not reach a resolution, but you learn something about both sides' positions, and how they will approach the settlement."
