Leaves of Absence: Navigating State and Federal Leave Laws With Minimal Disruption to the Business

On November 6, 2006, Catherine P. Wells, a member of Wolff & Samson's Employment Law Group, together with J. Frank Vespa-Papaleo, Esq, the Director of the New Jersey Division on Civil Rights, presented an in-depth seminar entitled "Leaves of Absence: Navigating State and Federal Leave Laws With Minimal Disruption to the Business" at the 15th Annual Conference of the Garden State Council's Society of Human Resources Management. Ms. Wells and Mr. Vespa-Papaleo focused on navigating the complex issues regarding leaves of absence under federal and state laws while simultaneously minimizing the costs and other disruptions to the business. This program highlighted the differences between the Family and Medical Leave Act and the New Jersey Family Leave Act, the complex issues relating to reinstatement, an employer's obligation to accommodate a disabled employee or to provide job restructuring as well as the practice and procedures employed by the New Jersey Division on Civil Rights determining whether there has been a violation of the New Jersey Family Leave Act.
