Michael R. Caruso, an associate, practices in the areas of litigation, commercial foreclosure, bankruptcy and creditors' rights. He represents banks, servicers and private lenders in workouts, restructurings and litigation involving distressed and defaulted loans. Michael regularly prosecutes contested commercial mortgage foreclosures, many with receiverships, and enforces negotiable notes. He also counsels investors in acquiring loans from other institutions and bidding at auction. As part of the Bankruptcy and Creditors’ Rights Group, Michael represents the firm’s clients in all aspects of reorganization and liquidation proceedings.

REPRESENTATIVE MATTERS

  • Representing a national bank as proponent of a confirmed Chapter 11 plan of liquidation for a $6 million sale of real estate, resulting in payment of the bank’s secured debt in full, including interest and attorneys’ fees and a significant dividend to other creditors 

  • Representing a Chapter 11 trustee in the $13.7 million sale of a beachfront 354-unit apartment complex in Atlantic City, New Jersey 
  • Representing a New York City hospital and its affiliates as Chapter 11 debtors-in-possession 
  • Representing sureties, mortgagees, commercial landlords/tenants and other interested parties in contested bankruptcy matters and adversary proceedings
  • Representing a real estate developer as intervenor in a tax foreclosure of land integral to the waterfront redevelopment of Asbury Park, New Jersey
  • Successfully foreclosing mortgaged office buildings, shopping centers, hotels and mixed-use real estate
  • Successfully defending a New Jersey public entity by obtaining summary judgment dismissal of all claims

Upon graduation from law school, Michael clerked for the Hon. Jamie D. Happas, J.S.C. and the Hon. Andrea Carter, J.S.C., each of the Superior Court of the New Jersey, Law Division, Middlesex County. While attending Rutgers University School of Law, Michael received the distinction of “Top Ten Petitioner Brief” in the James J. Hunter Advanced Moot Court Competition.
